Todd Tucker Seeks Primary Custody, Questions Prenup Amid Divorce

Kandi Burruss’ estranged husband, Todd Tucker, has requested primary custody of their two kids and is questioning their prenup in their divorce.

Tucker, who shares Ace, 9, and Blaze, 6, with Burruss, claims her ongoing work commitments will keep her away “for at least the next several months,” which prompted him to pursue primary custody, per court documents.

“The parties have been working cooperatively in an effort to resolve all issues, and [Tucker] remains committed to continuing those discussions in good faith,” Tucker’s filing read in his Nov. 26 divorce petition.

Burruss filed for divorce on November 21, formally ending her 11-year marriage to Tucker. In the filing, she requested joint custody of the children.

Tucker says that if he and the Real Housewives of Atlanta star are unable to reach a custody agreement, he will seek primary physical custody, joint legal custody, and final decision-making authority.

The TTucker Productions LLC founder also brought up their prenuptial agreement. He says he signed the document before their April 4, 2014, wedding but claims it was presented immediately before the ceremony without his attorneys present.

“Despite that knowledge, [Burruss’] counsel presented the final agreement to [Tucker] for signature immediately before the wedding ceremony, without any notice to or consultation with [Tucker’s team], who had been significantly engaged in the negotiation process,” his legal team alleged in the filing.

In addition, he is asking the court to divide all marital assets, including real estate and personal property.

In the petition, Tucker did praise his ex, saying “that he recognizes [Burruss] as a loving and capable parent and remains sincerely hopeful that prior and continued discussions between the parties will bring full resolution of all matters.”
