As Sean “Diddy” Combs’ trial continues, his legal team is fighting to have part of Kid Cudi’s testimony tossed out.

According to reports, they submitted a letter to the judge requesting that Cudi’s testimony about his torched Porsche be removed due to claims that he lied about Diddy’s involvement. Kid Cudi testified for the prosecution last week and talked about meeting up with the Bad Boy founder at Soho House after the car was damaged.

While on the stand, he described Diddy as a “Marvel supervillain.” However, Diddy’s legal team feels that the focus should be on their exchange when he was asked if he believed Diddy after he claimed that he was unaware of the damaged Porsche. The “Day & Night” rapper said that Diddy was lying.

His legal team also believes that Cudi’s remark is more of an opinion that can sway the jury and feels that Judge Subramanian should strike it from his testimony. On the other hand, prosecutors are using the 2012 incident as well as others to support the claim that Diddy has a pattern of racketeering activity, including arson.

It has been publicly reported that the DNA found on the car came from a woman, and Diddy’s legal team also pointed out that Kid Cudi has previously stated that he had “no personal knowledge that anybody affiliated with Mr. Combs was on or around his property at the time of the damage to his vehicle.”
