The Atlanta attorney was hit with a civil suit by Kody Clark and Lauren Hammett over a 2022 car accident. The suit accuses Sterling of driving recklessly while under the influence and hitting another vehicle, causing the two plaintiffs to suffer injuries.
Sterling reportedly crashed his 2011 Ford Mustang into a 2014 Toyota Camry driven by Kody Clark on the highway in Sandy Springs. Clark said he was driving a 2014 Toyota Camry in a “safe, careful, prudent manner.” Laura Hammett was also in the car with Clark and seated on the passenger side.
Both complainants allege they “suffered multiple injuries” from the crash and accumulated medical expenses that reached over $2,000. In addition, they claim to have suffered emotional distress, significant injuries and a loss of enjoyment of life due to the “violence of the collision.”
Sterling has yet to respond to the lawsuit, but the lawyer has been trying to beat the pair’s DUI allegations for a year now.
According to the suit, Sterling was immediately brought to the emergency room where a medical examination was performed in the presence of an officer. The medical examiners stated, “despite injection of his eyes, he otherwise does not have any slurred speech or inebriation at this time.”
Sterling lawyer added, “There was no odor or smell of alcohol in the medical report. Indeed, both nurses were subpoenaed for the administrative hearing in this case and were prepared to testify that if they smelled the odor of alcohol, it would have been included in their report. They would have testified that the fact that they did not include it in the medical report means they did not detect the smell of alcohol. They never testified at the administrative hearing because the officer agreed to dismiss the case because he failed to properly advise Mr. Sterling of the implied consent rights.”
Although Sterling admits the accident took place, he vehemently denies being inebriated and at fault. He wants the entire case to be thrown out and for the plaintiffs to pay for all costs. He previously entered a plea of not guilty.
An investigation is still ongoing.
